Overview

Newton Rest Haven Nursing Home is an 82-bed facility located in a town of 3,000 in southeast Illinois. A NHRMA Mutual member for 15 years, they have had a limited number of workers’ compensation claims during this period, and the few claims they’ve had have been generally settled amicably.

Situation

A Newton Rest Haven employee recently filed a knee injury claim after slipping on a wet floor. Even though Paula Schoonover, the administrator, knew that the injury was the result of a pre-existing condition, not the slip, she agreed to settle the claim to put this matter behind them. However, when the employee did not accept the initial offer the home decided to fight the claim.

The facility was not experienced in contesting this type of claim, so they enlisted the help of NHRMA Mutual.
